When Can I Apply for SSD Benefits?

SSI and SSD Benefits Lawyer in Philadephia, Pennsylvania

If you are currently out of work because of a physical injury or condition, an illness, or a mental condition there is no reason to wait to apply for SSD or SSI benefits.

Simply put: If you think you have a disability, you can and should apply today.

At the law offices of Chermol & Fishman in Philadelphia, Pennsylvania, we put our experience working inside of the Social Security Administration to work for people in eastern Pennsylvania, New Jersey, and Delaware.

Co-founding partner David Chermol played an important personal role as an attorney for SSA in most of the major disability-related decisions handed down by the Third and Fourth Circuit Courts of Appeal over the last 10 years. During this time, he also provided training to many of the administrative law judges who decide these cases.

There Are No Disadvantages

When the Social Security Administration receives a completed SSD or SSI application — disability benefits can begin to add up. If the claim is eventually approved, SSA will send you a check for your back benefits.

Given how long the process can take in some cases — this can be a substantial amount.

By waiting to apply until you know for certain whether or not you will be out of work for at least a year, you only penalize yourself. You can lose out on back benefits. If it turns out that your condition improves or that you can do some other type of work without too much trouble — then the worst that can happen is that SSA will deny your claim.
